1. GENERAL PROVISIONS
Baldinini SRL, a company registered in Italy (listed in the companies register under number 01727100404), with registered office at Via Rio Salto I - 47030 San Mauro Pascoli (Fc)- Italy, sells products from Baldinini branded collections directly to its customers through the website https://www.baldinini-shop.com/ (hereinafter the "Site"). The sale of Products on the Site is subject to the following terms and conditions of sale (the "Terms and Conditions of Sale").
2. CONSUMER INFORMATION
2.1. The Products on the Site are only for sale to private customers ("Customer(s)" or "You"), with the Customer meaning any natural person making a purchase for purposes unrelated to their trade, business, profession or commercial activity. Only persons aged 18 years or over may purchase Products on the Site. The Products offered for sale on the Site can only be purchased from and delivered to the United Kingdom, the European Union and the non-European Union countries listed on the Site.
2.3. By placing an order, the Customer accepts and agrees to comply with these Terms and Conditions of Sale. Should the Customer not accept any of the conditions set out in the Terms and Conditions of Sale, they must not place an order to purchase any Products on the Site.
3. ORDER PROCESS AND CONFIRMATION
3.1. To purchase one or more of the Products, the Customer must select the Products they would like to purchase, as well as the colour and size. The Products chosen for purchase will be added to the Shopping Basket. If the Customer wishes to be able to save items in their Shopping Basket to continue their purchase later, they must first create an online account and be logged in when making the purchase. It is not possible to purchase without an online account/without registering.
3.2. The Customer is able to modify any information they have entered during the purchase process up to the moment of confirming the order. Once the order has been sent, the Customer is no longer able to modify or cancel the order.
3.3. The sales process shall be deemed completed only when the Customer sends the order to Baldinini by clicking on "Buy now" at the bottom of the purchase confirmation page. In order to submit the order, the Customer must provide their personal data, including their name, address, email address and payment details. The Customer must also tick the relevant box to confirm that they accept these Terms and Conditions of Sale. Before placing an order, Customers are advised to carefully review the summary of their order.
3.4. After the order has been placed, Baldinini will send the Customer an email to confirm receipt of the order by Baldinini and that it is being processed (the "Order Confirmation"). Customers may access their orders at any time in the "My Account" section on the Site, or by contacting Customer Services at email@example.com.
3.5. Baldinini reserves the right to not accept orders placed by the Customer if it deems that such orders do not meet the requirements for placing an order, and/or orders placed by persons with whom a legal dispute is pending concerning a prior order, and/or for any other legitimate reason, without giving any explanation. Baldinini reserves the right to not accept and to not process orders that appear to have been placed by traders and/or distributors.
3.6. For each Product for sale on the Site, an image of the Product shall be displayed on the Site, together with the unit price, colours and sizes available. Product images are provided purely and exclusively for illustrative purposes. The images and colours shown for the Products for sale on the Site may not correspond to those of the actual Products due to the use of different browsers and/or monitors or for other technical reasons. Baldinini is not responsible for any inaccuracy of the graphic representations of the Products shown on the Site if due to the aforementioned technical reasons.
4.1. Baldinini undertakes to guarantee availability of all Products offered on the Site; however in exceptional cases it may be the case that Products for sale by Baldinini on the Site are not actually available. The Customer is welcome to check the availability of the Products offered for sale on the Site at the time of purchase by writing to Baldinini at firstname.lastname@example.org.
4.2. Should the Products ordered by the Customer be temporarily unavailable, Baldinini shall inform the Customer by email. If the purchase price of the unavailable product has already been debited, a refund will be issued within 14 (fourteen) days via the same method as that used for the original order. Please also be aware that specific banking time frames may affect when the refund is visible in your account, depending on the conditions of the relevant bank. Baldinini has no control over when the funds are re-credited to your account, this is at the discretion of the bank in question.
5. PRICE AND PAYMENT
5.1. The prices of the Products for sale on the Site are stated in the product information.
5.2. All Product prices for delivery are inclusive of VAT (if applicable) and any indirect taxes (if applicable), but exclude customs duties and shipping costs (charged separately). Shipping costs vary based on the destination.
5.3. Baldinini accepts payment by Credit Card, Bank Transfer and PayPal.
5.4. For Credit Card and PayPal payments, the Products purchased will only be sent to the Customer after the Customer's payment card details have been verified and the Customer's bank has authorised the debit. Verification of payment card details may cause a delay, but will be carried out as quickly as possible and will not normally take more than 24 hours, although it may take longer. Once payment is received, the order will be processed.
6.1. Products shall be shipped to the address provided at the time of purchase. For security reasons, Baldinini will not ship to P.O. Boxes or accept any order where the identity of the recipient and the individual's address cannot be confirmed.
6.2. All purchases shall be delivered by the courier service chosen by Baldinini ("Courier").
6.3. Products shall be delivered within 2-15 working days from the Shipping Confirmation, depending on the shipping address and the recipient's country of residence. Before shipping the Customer's purchases, Baldinini may need to confirm the Customer's details with the card issuer. Baldinini undertakes to make every effort to minimise delays bearing in mind that such steps do not normally take more than 24-48 hours.
6.4. In the event that the Customer does not receive the Products within 7-15 (seven to ten) working days from receipt of the Shipment Confirmation, the Customer is advised to contact Baldinini by sending an email to email@example.com.
7. RIGHT OF WITHDRAWAL
7.1. Customers have the right to withdraw from the purchase agreement entered into with Baldinini, with no penalty and without specifying any reason, within fourteen (14) days from the date of delivery of the products purchased on the Site. The Right of Withdrawal does not entitle Customers to exchange the Product purchased for another Product.
7.2. In order to exercise the Right of Withdrawal, Customers must complete all sections of the return form, which can be downloaded from the "Returns and Refunds" page. Any returns not accompanied by the correct paperwork will not be accepted. The Customer must return the Products in their original "as new" condition.
7.3. Refunds will be issued to the Customer providing the Products have not been used or washed and are in the same condition as when they were delivered, complete with all parts and accessories and the original packaging. If the Customer exercises their right of return for all Products included in the same order, all the Products must be returned at the same time in the same shipment.
7.4. Baldinini reserves the right to check the returned Products and refuse the return of any Products that it deems do not comply with the requirements set out in point 7.3 above.
7.5. A refund shall be issued via the same means of payment used for the original purchase within 14 (fourteen) days from the date on which Baldinini first confirmed receipt of the Products returned by the Customer, providing that the conditions set out in point 7.3 have been met.
7.6. If the returned Products were purchased as a gift, the refund shall be issued to the person who made the payment. The refund payment date will be the same as the date of the initial payment to Baldinini. Thus, the original payer will not suffer any damages in terms of bank interest.
7.7. When returning Products to Baldinini , Customers must arrange for the goods to be returned, including all costs and risks associated with shipping. All costs associated with returning any products shall be borne by the Customer. Baldinini will not be held liable for refunding the price of Products sent by the Customer that have not been received by Baldinini due to loss, theft or damage not attributable to Baldinini.

8. AMENDMENTS AND RECTIFICATIONS TO THE TERMS AND CONDITIONS OF SALE
8.2. Baldinini shall do its utmost to ensure that the prices and other Product information displayed on the Site are accurate and up to date. However, there may be occasional misprints, misrepresentations or omissions ("Errors") relating to descriptions, prices, promotions, offers and availability of the Products in question. Baldinini reserves the right, at any time and without prior notice to the Customer, to correct Errors, to amend or update information, to rescind offers containing such Errors and to cancel any order at any time prior to dispatch.
8.3. Should the Customer's payment card be charged for an order cancelled under the terms of Clause 8.2, the Customer shall be notified without delay by Baldinini via email and a refund shall be issued to the Customer's payment card within 14 (fourteen) days from the order cancellation.
9. ORDER COMPLIANCE
9.1. The Customer must check the Products at the time of delivery to ensure that they are consistent with those ordered.
9.2. The Customer may report any problem noted at the time of delivery, including but not limited to any tampering with or damage to the packaging, damage to the Products, missing items, incorrect Products, defective Products, etc. ("Defects"), by emailing firstname.lastname@example.org.
10. LEGAL WARRANTY FOR NON-COMPLIANT PRODUCTS
10.1. Baldinini Products offered for sale are covered by a 24-month legal warranty starting from the date on which the Customer receives the Products ("Legal Warranty Period"). The Legal Warranty Period covers any manufacturing defect and non-compliance of the Products. Without prejudice to any other recourse under applicable law, if, during the Warranty Period, a Product delivered to the Customer is found to be defective or non-compliant with the Product ordered (a "Defective Product"), the Customer shall be entitled to return the Defective Product to Baldinini for full repair at no additional cost within a reasonable period of time from the request; should full repair not be suitable, Baldinini may replace the defective Product with a new one within a reasonable period of time from the request. In any case, the Customer forfeits these rights if they fail to notify Baldinini of the non-compliance within a period of two months from the date on which they became aware of the defect.
10.2. Defective Products must be returned for repair as follows:
(a) The Customer shall inform Baldinini of any defect or non-compliance of the Product(s) purchased within the Legal Warranty Period by contacting Customer Services at the following email address: email@example.com. The email must include the Product details, images of the defect, images of the soles and a description of the defect.
(b) Baldinini will review the information provided and if it acknowledges the defect, it will arrange collection of the Product (subject to exceptions). Shipping and insurance costs for the Products shall be borne by Baldinini.
10.4. Baldinini reserves the right to inspect the returned Products to confirm the existence of the defect or non-compliance and may return the Products to the Customer if it deems that there is no defect or non-compliance present.
11. LIABILITY OF BALDININI
11.1. The Products for sale on the Site are supplied "subject to availability". Without prejudice to the legal warranty set out in clause 10.1 above, Baldinini disclaims all warranties, conditions, undertakings or terms, express or implied, under contract or otherwise, as to the condition, performance, satisfactory quality or fitness for purpose of the Products beyond the Product description included in the purchase order, and any such warranties, conditions, undertakings and terms of such nature are precluded to the fullest extent permitted by law.
11.2. Baldinini shall not, under any circumstances, be held liable for damages of any nature whatsoever, including but not limited to direct, indirect, incidental or consequential damages, which may be caused to the Customer and arise directly or indirectly from:

Subject to clauses 11.1 and 11.2, nothing in these Terms and Conditions of Sale shall exclude or limit the liability of Baldinini with regard to the Customer for fraud, death or personal injury caused by negligence, any breach of terms under applicable consumer protection laws or any other liability that cannot be excluded or limited under applicable legislation.
12. APPLICABLE LAW AND JURISDICTION
12.1. These Terms and Conditions of Sale are subject to Italian law in all matters.Any dispute relating to the interpretation and implementation of these Terms and Conditions of Sale shall be subject to the jurisdiction of the Court of the place where the Customer, as the consumer, has their residence.
12.2. Should any of the provisions contained in these Terms and Conditions of Sale be deemed invalid, void or unenforceable for any reason whatsoever, such provision shall be deemed separate and shall not affect the validity and enforceability of any other provisions.
